Shipment lost. Who is responsible?

Not sure how to handle this issue.
I sold a product on this forum.

The Buyer uses Paypal for protection.
the BUYER setups up and pays for shipping and insurance
I, the seller receives an email from FedEx with the Shipping label
I drop the package off to Fedex and it begins its journey

Fedex loses the package.
The buyer contacted me and we can both see that it was shipped.
The Buyer even agrees that this is not my fault

The Buyer then files a dispute with Paypal and now I am on the hook for the money.
Paypal is not the best at looking into things and since the buyer didn't receive the package, that's all they care about.

The Buyer is not responding to my messages to get this taken care of.

My opinion is that since the BUYER paid for shipping and insurance, it is his responsibility to file a claim and recoup his money
Now if I setup and paid for shipping, I get it. but the buyer set this up.

This has the potential for double dipping. He can file a claim with FedEx and have Paypal collect the money from me. I'm not accusing him of doing that, but the potential is there, and I would never know.

Am I missing anything? I don't think I am responsible.

Where is the FedEx tracking showing the last status for package. Did you created the fedex label?

Read the post. Buyer sent a label from their account.


OP - If you shipped(tracking confirms that) then your duty is done. Especially if the buyer provided the label. Call PayPal and explain this to them. Send proof of the buyer generated label and the communication you have. You should be able to get it fixed in your favor.

I did NOT create the label. The Buyer did and Fedex emailed me the label. last show was in Ohio. the buyer has contacted Fedex and claims that it is lost. Package made it to California and then was returned to Ohio. Its lost for sure but in my opinion does that make me responsible since I did not setup shipping

I did send all this info to paypal and they only care about if it was delivered or not so they are kind of useless. Paypal say the buyer is the one that should close the dispute. I have also sent screen shots to the buyer and no response.

Have you contacted FedEx to see if an insurance claim was started for the package? If you have that information in writing from FedEx, you can use it in your case with PayPal.
good idea. I was letting the Paypal dispute process play out 1st. I figured it was common sense on this one but it's been several weeks and paypal seems to worthless

That is not cool we we give people the benefit of the doubt and they still take advantage. A definite report, especially if he does not get back to you with an explanation.

I guess I will never use someone else label if they offer. Never would have occurred to me what would happen if the package got lost.

Taking your money while also being reimburse from fedex for the items value is very dishonest.

lol yeah I just learned that lesson. I am still waiting to hear from them on this before I go any further with it. Never know a person circumstances but it is looking more like I was ripped off

Just hung up with Paypal and they agree that since the Buyer setup and paid for shipping it is their responsibility and the dispute should close in my favor.

They will also call FedEx to confirm that this person made a claim and it was paid. They said it is fraud. Maybe there is hope for paypal
